PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THE #FACEYOURFEARSFEBRUARY competition (the “Competition”)

The Welsh Rugby Union Limited (the “WRU”) is registered in England and Wales under company number 03419514 and has its registered office at Principality Stadium, Westgate Street, Cardiff CF10 1NS. The WRU is the promoter of this Competition; will conduct, manage, promote and operate the Competition and will also be responsible for fulfilment of these Competition Terms and Conditions (“Competition T&Cs”). All persons who seek to participate in and/or submit an entry to this Competition are referred to as “you” and “the entrants” (and all references to your and “the entrant’s” shall be construed accordingly).

By participating in and submitting your entry to the Competition to which these terms are attached and made available to you at the point of submission of your Competition entry, which is the Competition for a maximum of one (1) entrant to win two vouchers equivalent to the value of two SCALE The Stadium rooftop climbs (subject to availability). You fully agree and accept these Competition T&Cs which you confirm to have read and understood together with any specific instructions and terms for the Competition which may be mentioned on the relevant Competition section of the WRU website (the “Competition Information”).  Please print a copy for your records.

  1. Eligibility

1.1      The Competition is open to entrants that reside within the United Kingdom only.

1.2      Subject to Clause 1.3, the Competition is only open to invited participants over eighteen (18) years or you must fall within the applicable age ranges specified on https://bookings.principalitystadium.wales/stadiumtours/scale.htm. Where a participant is under the age of eighteen (18) years old but fall within the age ranges described, you therefore may only enter the Competition in accordance with these Competition T&Cs if you have the legal guardian’s prior consent for the relevant participant(s) to (i) enter this Competition and (ii) to accept these Competition T&Cs.  If we have any cause to believe you do not have the relevant consent(s), we may cancel your entry at any time and you will not be entered into the Competition and/or your eligibility to the Prize will be void.

1.3      The following may not enter the Competition:

(a)       employees of the WRU or any of its holding or subsidiary companies;

(b)       employees of agents or suppliers of the WRU, or any of its holding or subsidiary companies, who are professionally connected with the competition or its administration;

(c)       members of the immediate families or households of (a) and (b) above.

1.4      To enter the Competition, entrants must follow the @scalethestadium Instagram account (https://www.instagram.com/scalethestadium/), ‘like’ the competition post, ‘tag’ a friend or family member in the post comment section and ‘share’ the post to their story ‘tagging’ the @scalethestadium Instagram account before the Closing Date (as defined in Clause 2.3 below) expires. All entries must be made directly by the person entering the Competition.

1.5      By entering the Competition you confirm that all information submitted by you is true, current, and complete and that you confirm that you are eligible to enter and claim the Prize if you win.

1.6      The WRU may require you to provide proof that you are eligible to enter the Competition.

1.7      The WRU will not accept Competition entries that are:

(a)       automatically generated by computer;

(b)       completed by third parties or in bulk;

(c)       illegible, have been altered, reconstructed, forged or tampered with; or

(e)       incomplete.

  1. Competition Information, How to Enter, and Selection Process

2.1      Entry to the Competition is free but entrants should be aware that they may be subject to data charges depending on their own individual arrangements for internet access.

2.2      In order to enter the Competition, entrants are required to (i) ‘follow’ the @scalethestadium Instagram account (https://www.instagram.com/scalethestadium/), ‘like’ the competition post, ‘tag’ a friend or family member in the post comment section and ‘share’ the post to their story ‘tagging’ the @scalethestadium Instagram account as detailed in the Competition information and (ii) accept these Competition T&Cs.

2.3      The Competition will be open for the period described on the Instagram post on which the Competition is detailed, and shall close at 11:55pm GMT on 29/02/2024 (the “Closing Date”). After the Closing Date, no further entries to the Competition will be permitted.

2.4      No responsibility is accepted for entries not received for whatever reason, including for entries lost, delayed or corrupted, or due to computer or internet or software error in transit, failure of any email or software programme or its failure to transmit, failure to send or submit the registration form correctly in accordance with the requirements in these Competition T&Cs.

2.5      Each participant is entitled to a maximum of one (1) entry to the Competition.

2.6      The winners will be chosen at random from all entries received and verified by the WRU and/or its agents by the Closing Date (or earlier, at the discretion of the WRU). The decision of the WRU is final and no correspondence or discussion will be entered into.

2.7      The winners will be notified by direct Instagram message on or around 01/03/2024 using the Instagram handle provided by the entrant when entering for the Competition. Reasonable efforts will be made to contact the winner. If the winner cannot be contacted within five (5) days of this date or if the winner fails to communicate their acceptance of the Prize to the WRU within five (5) days of being contacted by the WRU, or is unable to comply with these Competition T&Cs, the WRU reserves the right to either forfeit the Prize or offer the Prize to the another eligible participant drawn at random (in each case in the WRU’s sole discretion). The Prize may not be claimed by a third party on your behalf.

  1. Prize

3.1      The Prize is provided by the WRU.

3.2.     The Prize is subject to these Competition T&Cs, and any further regulations relating to the use of the Prize including any terms and conditions of attendance imposed by the WRU. By accepting the Prize, the winner agrees to comply (and shall procure that of any participant(s) in the Prize shall comply) with any and all applicable terms and conditions and regulations at all times (including any terms that apply when receiving the benefit of the Prize).

3.3      No cash or credit alternative to the Prize will be offered. The Prize is non‐refundable, non‐transferable and non-negotiable. The Prize is subject to availability and the WRU reserves the right to substitute any Prize with another of equivalent or similar value without giving notice.

3.4      In the event of a Prize becoming unavailable, the WRU reserves the right to offer an alternative prize of equal OR similar value.

3.5      The WRU assumes no responsibility and will not be liable for any costs, charges, expenses or arrangements that a winner(s) may be required to pay or incur at any time in connection with a Prize (including, but not limited to, any travel and/or accommodation and/or food expenses which do not form part of the Prize). Where travel is required to make use of the Prize, the winner(s) is(are) solely responsible for expenses and arrangements not specifically included in the Prize. This may include travel, accommodation and any necessary travel documents, passports and visas.  If you are unavailable on the date of the Prize, this will not be the WRU’s responsibility and you will have no recourse to the WRU. In such circumstances your Prize will lapse and the WRU reserves the right to choose another participant to benefit from the Prize.

3.6      The WRU reserves the right in its sole discretion to withhold delivery of (and/or access to) the Prize until proof of eligibility and/or identity requested by the WRU has been confirmed. If such proof is not produced on request, the WRU may disqualify the entrant from the Competition.

3.7      The winner is responsible for ensuring they are able to accept the Prize as set out and in accordance with these Competition T&Cs. In the event they are unable to do so, (i) the WRU reserves the right to choose another participant to benefit from the Prize and (ii) the WRU will not be responsible for any inability of any winner(s) to accept and/or take up the Prize.

  1. Publicity and Use of Entry Materials

4.1      The WRU must either publish or make available information that indicates that a valid award took place. To comply with this obligation the WRU will send the surname and county of the Prize winners and, if applicable copies of their winning entries, to anyone who emails customercare@wru.wales or writes to the following address (enclosing a self-addressed envelope, within one (1) month after the Competition has closed):

4.2      If you object to any or all of your surname, county and winning entry being published or made available, please contact the WRU at customercare@wru.wales. In such circumstances, the WRU must still provide the information and winning entry to the Advertising Standards Authority on request.

4.3      In addition to the announcement described above, the winner agrees (and warrants and undertakes to the WRU that is shall procure relevant consent from the parents and/or legal guardians of all children participating in the Prize) to participate in reasonable publicity relating to this Competition, including but not limited to having their name, photograph or other imagery (including video) and disclosure of county of residence published with their entry and used for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid and will co-operate with any other reasonable requests by the WRU relating to any post‐winning publicity.  A consent and release form will be issued to the winner detailing this further, including the winner’s right to withdraw consent to these publicity activities.

4.4      In addition to Clause 4.3 above, the winner further acknowledges and agrees (and warrants and undertakes to the WRU that is shall procure relevant consent from the parents and/or legal guardians of any children participating in the Prize) that if you are a winner and you perform the Prize, the WRU and the WRU’s broadcast partners and other relevant affiliates and associates shall be permitted to use and exploit such performance and the name and images of the participant(s) performing in the Prize in perpetuity and without any fee being paid to you or any participant(s) in the Prize (including through broadcast, media, social media, photography and all other media whether know known or hereinafter invented).

4.5      All Competition entries and any accompanying material registered and/or submitted to the WRU will become the property of the WRU on receipt and will not be returned.

4.6      By submitting your Competition entry and any accompanying material, you agree to:

(a)       assign to the WRU all your intellectual property rights with full title guarantee; and

(b)       waive all moral rights, in and to your entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

  1. Personal Data

5.1      By participating in the Competition, you acknowledge that your name, address, e‐mail address and date of birth will have been made available to the WRU (the “Personal Data”).

5.2      All Personal Data will be held and used by the WRU in accordance with the WRU’s privacy policy (which can be found at https://www.wru.wales/legal/legal-and-privacy/). By entering the Competition, you agree that any personal information provided by you with your entry to the Competition may be held and used by the WRU and/or its agents for the purposes of administering the Competition. If you win the Prize and that Prize relates to a match, stadium tour or access to team training sessions, the WRU will process your Personal Data in connection with such attendance including for security purposes.  See also paragraph 4 of these Competition T&Cs with regards to announcement of winners and disclosures during any performance relating to your Prize. The WRU may also use the information you provide to verify your age and identity.

  1. General

6.1      Any entrant must comply with (and ensure that any other participant(s) in the Prize comply with) any directions given to him or her by the WRU and/or its affiliates, partners, employees, agents and distributors including but not limited to any and all relevant laws, rules and regulations.

6.2      Any entrant who enters or attempts to enter the Competition in a manner, which in the WRU’s determination, is contrary to these Competition T&Cs or is unfair, fraudulent or unjust to other entrants or is otherwise not in the spirit of the Competition (including without limitation tampering with the operation of the Competition, hacking, cheating, deception, or any other unfair playing practices such as intending to annoy, abuse, threaten, or harass any other entrants or the WRU and/or any of their respective agents or representatives), may be rejected from the Competition at the WRU’s sole discretion.

6.3      The WRU may cancel or amend the Competition, the Prize, Competition information, or these Competition T&Cs without prior notice and for any reason, including (without limitation) in the case of a manifest error. Any changes will be posted either within the Competition information or these Competition T&Cs.

6.4      The WRU cannot guarantee that the services relating to the Competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. Without limiting this clause, the WRU reserves the right to modify, cancel, terminate or suspend the Competition in whole or in part, at its sole discretion, if it believes the Competition is not capable of being conducted as specified in these Competition T&Cs or in the event of system failure, maintenance or repair, network issue, a virus, computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of the WRU that could corrupt or affect the administration, security, impartiality, or normal course of the Competition, including, but not limited to the unavailability of the vote, poll, competition or Prize draw entry platform before the closing date, or for strike, lock‐out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The WRU are not responsible for any loss or damage caused to you as a result of any of these occurrences. By submitting an entry to the Competition, you will be deemed to have agreed to any new or amended terms and conditions.

6.5      Insofar as is permitted by law, the WRU, its affiliates, partners, employees, agents and distributors will not in any circumstances be responsible or liable to compensate the winner(s) or accept any liability for any claims, demands, loss, damage, theft, personal injury or death occurring as a result of taking up the Prize, or entering into this Competition, except where it is caused by the negligence of the WRU, its affiliates, partners, agents and distributors or that of their employees. Your statutory rights are not affected.

6.6      You agree to fully reimburse the WRU in respect of any damages suffered by the WRU for any losses it incurs resulting from any claim made by a third party in each case in respect of any matter arising from your entry to the Competition, your use of the services relating to the Competition in breach of the Competition T&Cs or from your violation of any applicable law or regulation.

6.7      The invalidity or unenforceability of any provision of these Competition T&Cs shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Competition T&Cs shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

6.8      The Competition and these Competition T&Cs will be governed by the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
